The website located at ourvirginislands.com (the “Site”) and any related mobile application(s) are operated by Our Virgin Islands, LLC (“Company,” “we,” “us,” and “our”). The Site and related services are copyrighted works belonging to the Company.

These Terms of Service (“Terms”) govern your access to and use of the Site and the services we provide through the Site (the “Service”). Certain features of the Service may be subject to additional guidelines, terms, or rules, which will be posted in connection with those features. All such additional terms are incorporated by reference.

By accessing or using the Site or Service, you agree to be bound by these Terms. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

1. Eligibility

If you are between 13 and 17 years old (or under the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, and your parent or legal guardian agrees to be bound by these Terms on your behalf.

You represent and warrant that all information you submit to us is accurate and complete.

2. Accounts

To access certain features of the Service, you may be required to register for an account.

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts at our discretion.

3. User Content

However, by posting or sharing User Content through the Service, you grant the Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, display, distribute, and perform such content in connection with operating and promoting the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not violate any law or infringe the rights of any third party.

4. Prohibited Conduct

You agree not to:

• Use the Service for unlawful purposes.
• Harass, threaten, abuse, or harm other users.
• Post defamatory, obscene, hateful, discriminatory, or otherwise objectionable content.
• Upload viruses, malware, or malicious code.
• Attempt to gain unauthorized access to accounts or systems.

Zero Tolerance for Objectionable Content and Abusive Behavior. There is zero tolerance for objectionable content or abusive users on the Service. Objectionable content includes, without limitation, content that is unlawful, harassing, threatening, abusive, defamatory, obscene, sexually explicit, hateful, discriminatory, or that otherwise harms or harasses other users. By using the Service you agree not to post objectionable content or behave abusively toward other users.

You may report objectionable content or abusive users at any time using the in-app report and block tools, and reports are sent to our moderators. We will review reported content and act on objectionable content reports within 24 hours by removing the offending content and ejecting the user who provided it. We may remove any content and suspend or terminate any account that violates these Terms, with or without notice.

5. Marketplace, Listings, and Community Features

The Service may include classified listings, events, jobs, rentals, community spaces, forums, messaging, and other user-generated features.

We do not guarantee the accuracy, safety, legality, quality, or availability of any user-submitted content, listings, or interactions.

Transactions and interactions between users are solely between those users. The Company is not responsible for disputes, damages, losses, or issues arising from user interactions.

6. Intellectual Property

Except for User Content, all content and materials available through the Service — including logos, graphics, software, designs, text, and trademarks — are owned by the Company or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.

7. Third-Party Services and Links

The Service may contain links to third-party websites, services, or advertisements. We do not control or endorse third-party services and are not responsible for their content, practices, or policies.

Your use of the Service is also governed by our Privacy Policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.

IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, affiliates, and agents from and against claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the United States Virgin Islands, without regard to conflict of law principles.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

15. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, please contact us with sufficient information to investigate the matter.

16. App Store Terms

If you access the Service through a mobile application obtained from Apple’s App Store or Google Play, you acknowledge that Apple and Google are not responsible for the Service and have no obligation to provide support.

17. Miscellaneous

• Entire Agreement. These Terms constitute the entire agreement between you and the Company.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver. Failure to enforce any provision is not a waiver of rights.
